1. Acceptance of Terms
By accessing or using the KeepFlow products and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Services.
2. Description of Services
KeepFlow provides a suite of software products including Respondo (customer service automation), Tracio (digital identity and fingerprinting), and CodeVeil (data protection and obfuscation). The Services are provided on a subscription basis.
3. Account Registration
To use certain features of the Services, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account.
4. Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose or in violation of any applicable law or regulation
- Attempt to gain unauthorized access to the Services or any related systems
- Interfere with or disrupt the integrity or performance of the Services
- Reverse engineer, decompile, or disassemble any aspect of the Services
- Use the Services to send spam, phishing messages, or other unsolicited communications
5. Payment Terms
Paid features of the Services require a subscription. Subscription fees are billed in advance on a monthly or annual basis, depending on the plan you choose. All fees are non-refundable unless otherwise specified in these Terms.
6. Intellectual Property
The Services and all associated content, features, and functionality are owned by KeepFlow and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You retain all rights to your data and content that you upload or transmit through the Services.
7. Data Processing
Our processing of personal data is governed by our Privacy Policy. For enterprise customers, we offer Data Processing Agreements (DPAs) that comply with GDPR and other applicable regulations.
8. Service Level Agreement
We strive to maintain 99.9% uptime for all Services. Specific service level commitments may be detailed in separate agreements for Enterprise customers. We will provide reasonable notice of scheduled maintenance.
9. Limitation of Liability
To the maximum extent permitted by law, KeepFlow shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability for any claims arising from or related to the Services is limited to the amount you paid us in the 12 months preceding the claim.
10. Termination
Either party may terminate the subscription at any time. Upon termination, your right to access the Services will cease. We will provide a reasonable period for you to export your data. We may suspend or terminate your access if you violate these Terms.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the United Arab Emirates, specifically the Dubai International Financial Centre (DIFC) courts.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.
